Do I need an attorney?
One of the services you can expect from Patton, Hoversten & Berg, P.A. is a prompt assessment of the merits of your case. In some cases, if your injuries are minor (no lasting pain or disability, no disfigurement or scarring, and medical expenses under $4,000.00), you may not need an attorney. On the other hand, in virtually all cases involving serious injury or death, an attorney should be consulted. These cases tend to involve complicated factual and legal issues. Another reason to have an attorney is that, in cases involving serious injury or death, experience shows that a claimant not represented by an attorney recovers far less on their claim than a similarly injured person who has an attorney. Whether your case is large or small, we would be happy to talk with you without cost. After talking with you, we will give you our opinion as to whether legal representation is advisable.
Who pays for my medical expenses and wage loss?
The laws in Minnesota state that every automobile must be covered by a policy of insurance that provides up to $20,000.00 in coverage for medical expenses and up to $20,000.00 in coverage for wage loss, replacement services, and certain other expenses. This insurance, at least initially, pays for your medical expenses and part of your wage loss (wage loss is subject to a maximum per week). When this insurance coverage is exhausted, you will have to rely upon your private health and income replacement insurance to cover your losses. We will provide you with more complete information on these issues at your request.
How do I pay you for your services?
We are not paid any legal fees, unless we win your case. Our fee arrangement is called a contingency fee, which means we are paid a portion of the recovery. If there is no recovery, there will be no fee for our services.
