Criminal Law

The bedrock of our American democratic values is our fundamental belief in the basic human rights of individual liberty and property. Our belief in these rights is meaningless unless lawyers and the courts can defend them and provide a remedy when the government violates those rights. Our rights are not "technicalities" - they are what separate us from dictatorships.

The attorneys of Patton, Hoversten & Berg, P.A. bring over 59 years combined experience as criminal trial lawyers to your case and into the courtroom. We have handled criminal cases from both sides: as private defense attorneys and public defenders, and as an assistant county attorney and city prosecutor. This experience gives us well-rounded experience and perspective.

Licensed in federal and Minnesota courts, we handle all types of criminal cases, including traffic, drug, theft, assault and DUI. DUI's in particular become more complicated and carry more serious consequences every year and we have represented many people charged with these offenses. We are also able to help with the civil matters that frequently accompany a DUI - drivers license revocation, plate impoundment and vehicle forfeiture.

Even a first time DUI may have serious financial consequences including increased insurance rates, fines and surcharges, license fees, alcohol assessments and treatment costs.

It is important to remember that there are many challenges to a DUI. Police officers must follow a detailed set of procedures and even one mistake could result in the dismissal of the case.

For instance:

  • Were your constitutional rights violated?
  • Did the Officer follow the necessary arrest procedures?
  • Were you read a rights advisory?
  • Were you allowed to contact an attorney?
  • Was the test to determine blood alcohol levels properly administered?
  • Was the machinery that tested your blood alcohol level functioning properly and maintained correctly?
  • Were you denied your request for an alternative or second test?
