Under Minnesota law, a domestic assault charge is a misdemeanor unless you’ve been convicted of domestic assault in the last ten years, or the assault involves strangulation. In the case of a prior conviction within the designated time frame, the charge is a gross misdemeanor, and is punishable by up to one year in jail and/or up to $3,000 in fines. If strangulation was involved, you will be charged with a felony and could face up to three years imprisonment and/or a $5,000 fine.
