FYI -- There are groups in the United States, primarily insurance companies and physicians, who seem to feel that there are too many frivolous lawsuits against health care providers.  Many careful studies have found that this claim cannot be substantiated.  In Minnesota, at the time of filing a lawsuit against a physician, for example, a claimant must present an affidavit from another physician that verifies that the doctor being sued did, in fact, violate the standard of care (the care normally used in similar circumstances by physicians in good standing), and that the defendant-physician’s violation of the standard of care caused the claimant’s injuries.  This requirement ensures that only those cases in which the claimant has a good faith basis to believe that malpractice occurred ever reach the courthouse.
